Terms and Conditions
1) TRAVEL CONTRACT - RESPONSIBILITY
Travel contracts, as well as the sale of tourist packages, which have as their object services to be provided both domestically and internationally, are regulated, until
its repeal, pursuant to Art. 3 of Legislative Decree No. 79 of May 23, 2011 (the Tourism Code); by L. 27/12/1977 n. 1084 of ratification and execution of the Convention
International relating to the travel contract (CCV), signed in Brussels on 23/04/1970; as well as by the Tourism Code (Articles 32-51) and its subsequent amendments. The
liability of SM Events T.O., in its capacity as travel organizer towards travelers and their property is governed by the above-mentioned rules
referred to and may not in any case exceed the limits provided for therein.
2) RESERVATIONS AND PAYMENTS
Reservations are accepted until all available seats are filled. Acceptance of reservations is considered finalized, resulting in the conclusion of the contract, only at the
time when SM Events sends relative confirmation, including by telematic system. Unless otherwise agreed between the parties, upon booking, the client is required to
pay 30% of the participation fee as a deposit. The balance must be received within 30 days prior to the date of departure.
Failure to pay the above amounts by the established dates constitutes an express termination clause such as to determine, on the part of SM Events, the legal termination.
3) INSURANCE - GUARANTEE FUND
As a guarantee of the exact fulfillment of the obligations undertaken to customers, SM Events T.O. has taken out an insurance policy with Unipol Assicurazioni pol. No. 1/39189/319/81619988
pursuant to Art. 14 L.R. No. 7 of 31/03/2003 and Art. 20 D.LGT. 17/03/1995 n. 111.
4) WITHDRAWAL- INTERRUPTION OF THE STAY
In case of withdrawal from the travel contract the SM Events T.O., in addition to the charges and expenses to be incurred for the cancellation of services and the costs of handling the file,
will apply the following penalties, unless otherwise specified in the offer:
- 30% of the amount of the total amount if the cancellation reaches the organizing agency up to 30 days before the use of the booked services.
- 50% of the amount of the total amount if the cancellation reaches the organizing agency from 29 to 15 days before the use of the booked services.
- 80% of the amount of the total amount if the cancellation is received by the organizing agency up to 14 to 7 days before the use of the booked services.
- No refund after these terms.
In case of interruption of the stay, there will be no refund, except if the group is able to submit a specific statement from
hotel management of consent to reimbursement for services not provided.
The organizing agency in such a case will only reimburse the amount authorized by the hotel after deducting any agency fees and case management costs.
5) WITHDRAWAL WITHOUT PENALTY
Withdrawal without penalty is provided only in the following cases:
- increase in the price of the package booked by more than 10%
- essential changes to the contract after its completion.
It should be noted that the traveler must notify in writing to SM Events T.O. his choice to accept or withdraw within 2 (two) working days from receipt of the
change. In case of withdrawal, the traveler will be entitled to a refund of the sums already paid or alternatively to take advantage of another tour package of the same
quality.
6) VARIATIONS
It is acknowledged that SM Events T.O. has the right to replace hotels and/or resorts with others of similar characteristics for operational reasons or other needs
arising. Any failure of the traveler to adhere to the proposed change, to be manifested in writing within 2 (two) working days of receipt of the
proposal itself, will commit SM Events T.O. only to the reimbursement of the sums paid.
7) COMPLAINTS
Any failure or default in the performance of the contract must be objected to by the traveler without delay so that SM Events T.O. or its local representative
may promptly remedy it. Any written complaint must be sent, under penalty of forfeiture, by registered mail with return receipt no later than 10 working days from the date
of return to the place of departure. Since the compilation of the catalog is done well in advance of the actual provision of services, should any
changes from the description, have occurred in the meantime, SM Events T.O. cannot be held responsible in any way.
8) OBLIGATIONS OF PARTICIPANTS
Participants in the trip must be in possession of a passport or other valid document for all countries touched by the itinerary, as well as relevant residence and transit visas
and health certificates that may be required.
Participants must also comply with the rules of normal prudence and diligence, with all information provided by the organizer and with the regulations and
administrative and legislative provisions relating to the trip. Participants will be held liable for damages caused to the trip organizer due to their
failure to comply with the above obligations.
The participant is obliged to provide the organizer with all documents, information and elements in its possession that are useful for the exercise of the right of subrogation against
third parties responsible for the damage.
9) SALE OF SINGLE SERVICES
Contracts having as their object the sale of single services (lodging, transportation, etc...) and which therefore do not concern a tourist package, are governed by CCV articles 1, 3,
6; articles 17 to 23; articles 24 to 31, with the exclusion of what concerns a travel organization contract.
The other general conditions of sale listed above are also applicable without configuring in any case a tourist package.
10) BAGGAGE
Baggage travels at the participants' own risk, and the organizing agency can under no circumstances be held liable for any loss or damage.
11) QUOTES
All prices include VAT and service percentages. In the event of a Vat increase, prices must be adjusted to reflect the changes.
12) COMPETENT COURT
It is established that, disputes and disputes arising from the application and execution of the contract, shall be referred to the competent court of the Republic of San Marino.
13) PRIVACY - INFORMATION EX ART. 13 D.LGS. 196/06
The processing of personal data is carried out in accordance with the law, both in paper and digital form, for the purposes of the conclusion of the contract and for
the execution of the services that are the subject of the tourist package. The owner of the data processing is the Company SM Events S.r.l.
Personal data will not be disclosed to third parties, but will be communicated only to the providers of the services included in the tourist package and for the purposes referred to in the package
tourist, which will be required to comply with the law. Interested parties may exercise their rights under Art. 7 Legislative Decree 196/06 at any time by sending a
registered letter or pec to SM Events S.r.l.
14) GUARANTEEFUND
At the Presidency of the Council of Ministers, a national guarantee fund has been established to which the consumer may apply under Article 100 of the Consumer Code. of Consumption,
in case of insolvency or bankruptcy of the seller or organizer, for the protection of the following needs:
A) Reimbursement of the price paid
B) His repatriation in case of travel abroad
The fund must also provide immediate economic availability in case of forced return of tourists from non-EU countries on occasions of emergencies attributable or not
to the behavior of the organizer. The modalities of intervention of the fund are established by Decree of the Pres. of the Council of Ministers of 23/07/99 No. 349.
The organizer contributes to the aforementioned fund to the extent established by paragraph 2 of the aforementioned Article 100.
Claims for reimbursement to the fund are not subject to any time limit.
15) REFERENCE
For what is not expressly provided for in the general conditions, reference is made to the laws in force.
MANDATORY COMMUNICATION IN ACCORDANCE WITH ART. 16 LAW 296/98
Italian law and San Marino law punish with imprisonment crimes related to prostitution or child pornography even if committed abroad.
